Workers’ Compensation Bills that are currently pending before the 97th General Assembly (2012)

SB2521 (McCarter): Amends the Workers’ Compensation Act. Defines “accident” and “injury.” Provides that “injury” includes the aggravation of a pre-existing condition by an accident arising out of and in the course of the employment, but only for so long as the aggravation of the pre-existing condition continues to be the major contributing cause of the disability. Provides that an injury resulting directly or indirectly from idiopathic causes is not compensable. No longer allows an employee to choose in writing to decline their employer’s preferred provider program. Makes changes concerning the determination of the level of permanent partial disability. Effective immediately. Assigned to Labor Committee.

SB 3825 ( Raoul): Creation of the Workers’ Compensation Insurance Fund as an independent body for insuring employers against liability for workers’ compensation claims.

SB 3826 (Raoul): Creation of the Illinois Compensation Rating Bureau. The proposed bureau would be capable of providing more accurate and verifiable information on reimbursement rates on workers’ compensation cases. Currently, the state uses figures provided by the National Council on Compensation Insurance (NCCI).

SB 3807 (Maloney): Changing how all employers are charged for workers’ compensation premiums, from wages paid to an employee, to the hours worked by that employee.

SB 3808 (Maloney): Changing how construction employers are charged for workers’ compensation premiums, from wages paid to an employee, to the hours worked by that employee.

HB4484 (Mayfield): Amends the Workers’ Compensation Act. Provides that an employee shall reimburse the employer for the actual costs incurred by the employer for an independent medical examination if the employee has notice of the examination appointment, does not attend the examination, and does not cancel the examination appointment in a timely manner.
